General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) are concluded, on the one hand, by the municipality of Sainte-Marie-du-Mont, owner of the Communal Museum of the Utah Beach Landings, whose registered office is located at Mairie de Ste Marie du Mont, 2 Place de l’Église, 50480 Sainte-Marie-du-Mont, registered in the Trade and Companies Register under SIRET number 21500509100107, hereinafter referred to as “BOUTIQUE UTAH SHOP” and operating the website Utah Beach: https://utah-beach.com/en/, and, on the other hand, by any natural or legal person wishing to make a purchase via the Utah Beach website: https://utah-beach.com/en/utah-shop/, hereinafter referred to as “the buyer”.

1. Purpose

These General Terms and Conditions of Sale aim to define the contractual relationship between BOUTIQUE UTAH SHOP and the buyer, as well as the conditions applicable to any purchase made through the Utah Beach online shop: https://utah-beach.com/en/utah-shop/

Purchasing a product through this site implies the buyer’s unconditional acceptance of these GTCS, of which the buyer acknowledges having read prior to placing an order.

Before any transaction, the buyer declares that:

The purchase of products via the Utah Beach site is unrelated to their professional activity and is limited to strictly personal use;

They have full legal capacity to commit under these GTCS.

The municipality of Sainte-Marie-du-Mont reserves the right to modify these sales conditions at any time, in order to comply with any new regulations or to improve the use of its site. As such, the applicable conditions will be those in force on the date of the buyer’s order.

2. Use of the Site

The user agrees not to use the site for fraudulent purposes or in violation of current regulations. The municipality of Sainte-Marie-du-Mont, and in particular the Utah Beach Museum, does not guarantee uninterrupted access to the site and cannot be held liable in the event of temporary service interruption or maintenance.

3. Products

The products offered are those listed on the Utah Beach website: https://utah-beach.com/en/utah-shop/, within the limits of available stock. The municipality of Sainte-Marie-du-Mont reserves the right to modify the product range at any time.

Each product is presented on the website with a description of its main technical features (product description, composition, supplier, place of manufacture, etc.). The photographs are as accurate as possible but are not contractually binding.

The sale of products on the Utah Beach site is intended for all buyers residing in countries that fully authorize the import of such products.

4. Prices

The prices shown on the product pages of the online catalog are in Euros (€), including all applicable taxes (VAT) as of the order date. Any change in the VAT rate may be reflected in the price of products.

The municipality of Sainte-Marie-du-Mont and the Utah Beach Museum reserve the right to change prices at any time, provided that the price listed on the catalog at the time of the order shall be the only one applicable to the buyer.

The listed prices do not include delivery costs, which are invoiced in addition to the product prices based on the total amount of the order.

5. Order and Payment Terms

Before ordering, the buyer is not required to create an account. They only need to enter the necessary delivery and payment information when ordering via https://utah-beach.com/en/utah-shop/. A shopping cart is available to help select products before completing the purchase.

The buyer acknowledges having read and accepted these GTCS before placing the order. Confirming the order implies unconditional acceptance of these GTCS.

The municipality offers only one secure payment method:

Secure credit card payment via Paybox

the buyer selects products in the shopping cart, adjusts quantities if needed, checks or enters a delivery address, and views shipping fees and carrier name. Then, they select the “Secure credit card payment via Paybox” option. They are prompted to review the information, accept the GTCS by checking the relevant box, and confirm the order. The buyer is then redirected to the Paybox secure interface to enter their card details.

If the payment is accepted, the order is registered, and the contract is finalized. Payment by card is irrevocable.

In the event of fraudulent use, the buyer may request cancellation of the card payment. The amounts paid will then be refunded. If the disputed payment is proven to have been made fraudulently, remotely, without physical use of the card, the cardholder is not held liable.

To obtain reimbursement of the fraudulent charge and any related bank fees, the cardholder must file a written dispute with their bank within 70 days (or 120 days if contractually allowed). The bank must reimburse the amount within a month after receiving the complaint. No fee may be charged for the refund.

The confirmation of an order implies acceptance of the GTCS, acknowledgment of full understanding, and waiver of any other purchase conditions. All submitted data and the recorded confirmation will constitute proof of the transaction.

The buyer must provide a valid email address. The municipality will send an email confirmation to this address.

6. Delivery

Deliveries are made to the address specified on the order form, in countries where the Utah Beach Museum accepts to ship products. The museum offers product sales and shipping to all countries, subject to any local, customs, or legal restrictions that might prevent delivery to certain destinations.

Orders are shipped via La Poste, COLISSIMO service, with tracking and delivery without signature. Delivery times are indicative and may vary depending on the destination.

In the case of delivery to a foreign country, the buyer is responsible for any applicable taxes or customs duties that may be charged upon entry of the products into the destination country. The municipality of Sainte-Marie-du-Mont and the Utah Beach Museum cannot be held liable for such additional charges.

The museum will provide the buyer with a tracking number via email. If the buyer is absent during delivery, a delivery notice will be left, allowing them to collect the parcel at the post office or from the carrier under the specified conditions.

7. Right of Withdrawal and Return Policy

In accordance with Article L121-20 of the French Consumer Code, the buyer has a period of fourteen (14) working days from the date of receipt of the products to exercise their right of withdrawal, without needing to provide a reason and without incurring any costs other than return shipping fees.

However, this right of withdrawal does not apply to certain products, as per legal exceptions, notably:

Products that are personalized or custom-made;

Products which, for health or hygiene reasons, cannot be returned (e.g., personal care items or perishable goods);

Products which, after delivery, have been inseparably mixed with other items.

If the buyer wishes to exercise their right of withdrawal, they must notify the municipality of Sainte-Marie-du-Mont and the Utah Beach Museum in writing at:

Returned products must be in their original condition, undamaged, and preferably in their original packaging. Return shipping costs are the responsibility of the buyer.

Refunds will be issued within fourteen (14) days of receiving the returned products, using the same payment method as was used for the original purchase.

8. Warranty

All products supplied by the municipality of Sainte-Marie-du-Mont and the Utah Beach Museum are covered by the legal warranty provided under Articles 1641 and following of the French Civil Code.

In case of non-compliance of a sold product, it can be returned to the seller, who will exchange or refund it.

9. Retention of Title

The Utah Beach Museum retains full ownership of the sold products until the complete payment of the price, including all taxes and charges.

10. Liability

In the context of distance selling, the municipality of Sainte-Marie-du-Mont and the Utah Beach Museum are bound only by a best-efforts obligation. They cannot be held liable for indirect damages arising from use of the Internet, such as data loss, intrusion, viruses, service interruption, or any other technical issues that may occur during product purchase.

The museum shall not be held liable for the non-performance of the contract in case of force majeure, as defined under French case law, including (but not limited to): strikes, weather events, acts of terrorism, or any other circumstances beyond its control preventing the fulfillment of contractual obligations.

11. Intellectual Property

All elements of the Utah Beach website: https://utah-beach.com/en/utah-shop/ are and remain the intellectual and exclusive property of the municipality of Sainte-Marie-du-Mont and the Utah Beach Museum.

No one is authorized to reproduce, exploit, or use any part of the site’s content—whether photos, logos, visuals, or text—even partially, for any purpose.

12. Personal Data

The municipality of Sainte-Marie-du-Mont and the Utah Beach Museum commit to protecting the confidentiality of information provided by the buyer for the use of certain services.

The collected personal data is processed in accordance with the provisions of French Law No. 78-17 of January 6, 1978, as amended (“Informatique et Libertés”) and the EU General Data Protection Regulation (GDPR) No. 2016/679 of April 27, 2016.

Accordingly, the buyer has the right to access, rectify, erase, limit, port, and object to the processing of their data.

13. Evidentiary Value of IT Systems

Unless there is clear evidence to the contrary or an obvious error, it is agreed that data from the information systems of the municipality and the Utah Beach Museum—including order records, confirmations, electronic communications, and shipment tracking—shall be legally binding in the context of any dispute or claim, particularly regarding connection data, payments, or electronic processing.

These elements may be presented by the municipality as evidence in any legal dispute and will be accepted as valid by both parties.

14. Dispute Resolution

These General Terms and Conditions of Sale are governed by French law.

For all disputes or legal proceedings, the competent court will be the one where the museum’s registered office is located, unless legal provisions state otherwise.

Any dispute regarding the interpretation or execution of these GTCS may be submitted to an amicable settlement before any legal action. Customers are invited to send any complaints in writing within one (1) month from the event that gave rise to the complaint to:

In accordance with Article L. 612-1 of the French Consumer Code, the buyer may freely access mediation services offered by CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), whose contact details are:

After first contacting the museum in writing, and if no agreement is reached, the buyer may submit the matter to CM2C. This can be done online at www.cm2c.net or by post.

If no amicable resolution is reached, only the French courts will have jurisdiction.

15. Precedence of the French Version

These General Terms and Conditions of Sale are written in French. They may be translated into other languages for convenience. In the event of a discrepancy between a translated version and the French version, the French version shall prevail in all cases.
